The following plan changes have been proposed for the Wairau/Awatere Resource Management Plan and have not yet been made operative. The individual details of each proposed plan change is contained in the table below.

No. Variation 38 - Rural Issues

Description

 

The variation provides guidance for a range of issues arising from land use activities and subdivision in rural areas and updates the Plan to reflect the development that has occurred.

The Variation consists of the following:

Volume One- changes are proposed for the following chapters: Indigenous Flora and Fauna, Landscape, Natural Character, Urban Environments, Rural Environments, Land Transport.

Volume Two- changes are proposed to the following chapters: Definitions, General Rules, Subdivision, Standard Requirements for Subdivision and Development, Rural Residential and Rural 3 and 4 Zone and Residential 1 and 2 Zone.

Volume Three (planning maps) rezoning are proposed for several properties on Blenheim's periphery.

No. Plan Change 58 - Frost Fans

Description

 

The Marlborough District Council is proposing to change the Plan standards and requirements relating to frost fans. The proposed plan change involves the change in status of frost fans from a permitted activity to a controlled activity and includes the introduction of amended noise standards. The new requirements are proposed as a means for Council to proactively manage the adverse noise effects resulting from new frost fans. In order to mange reverse sensitivity effects associated with frost fans, a new rule is also proposed to establish a noise standard applicable to new habitable buildings located in close proximity to existing frost fans.

No. Plan Change 59 - Colonial Vineyards

Description

 

The plan change request is to amend the Wairau/Awatere Resource Management Plan in relation to the “Colonial Vineyards” site being Lot 2 DP 350626 located South of New Renwick Road between Richardson Avenue and Aerodrome Road.  The plan change requested is to rezone the existing 21.4 hectare property from Rural 3 to Urban Residential 1 and 2 to facilitate the residential development of the property.

The proposed plan change consists of the following: 

  1. Rezoning the property to Urban Residential 1 and Urban Residential 2 Zones.
  2. An indicative layout for roading and open space
  3. A requirement for acoustic insulation of dwellings within the site.
Additional polices to asses the appropriateness of any indicative roading and open space at the time of resource consent.

Description

 

A plan change request has been made by Kapiti Views Trust to add a new zone to the Wairau/Awatere Resource Management Plan.

The total area to be encompassed by the proposed zone is just less than 50 hectares.  The zone is proposed to be called Maxwell Hills Zone with its purpose to enable the residential use of the site.  The proposed plan change will enable the creation of approximately 160 lots ranging between 2,000 m2 and 4,000m2.

The site of the plan change is on part of the property owned by Kapiti Views Trustees Limited who own more than 300 hectares of land in the Taylor Valley near the intersection of Taylor Pass Road and Maxwell Pass Road.

The legal description of the site is:

  •  Lots 1-3 DP 357141 and Lot 1 DP 9518, being 320.919 hectares more or less on Certificate of Title 232445.
  • Section 2 SO 7014, being 8.8900 hectares more or less on Certificate of Title 5A/644.

 The Rural 4 zone currently applies to the site and all properties in the locality.

The site is 2.5 kilometres from the Urban Residential Two Zone which is the nearest residential zoned land forming part of the urban area of Blenheim.

Description

 

The purpose of the Plan Change is to make a number of minor amendments and alterations to the provisions of the Plan to:

  • Remove redundant provisions;
  • Provide greater clarity of the existing provisions to improve implementation

The items subject to this plan change are identified below:

  • Policy on term of water permits to take and use water
  • Definition of ‘Family Flat’
  • Setback from water bodies for reasons other than avoiding flood hazard
  • Remove references to a ‘Hazard’ Register
  • Controlled activity rule for development
  • Clarify that utility provisions apply to ‘requiring authorities’
  • Subdivision Chapter
    • Reconcile subdivision standards for Township Residential zone with site density standards
    • Clarify that building platforms must be free from easements and yard setbacks
    • Remove reference to section 321 of the Local Government Act
    • Remove references to compliance with Assessment Matters from the rule relating to controlled and discretionary subdivision activities
  • Include rules for the damming of water
  • Subdivisions in the Conservation Zone
  • Definition of ‘Wineries’
  • Amend the definition of ‘Home Occupation’ to reflect the intention that it can only be undertaken by a member of the household, plus one additional person.
  • Include drainage channels in the rules requiring discharge setbacks from water bodies
  • Earthwork volume limit exemptions in Rural Residential and Central Business Zones
  • Introduction of rules to enable Garden Maintenance

Description

The purpose of the proposed plan change is to introduce new objectives, policies, definitions and rules to the Wairau/Awatere Resource Management Plan. The new provisions will introduce consenting requirements for the conversion of land to new dairy farms. The consenting requirements will allow for controls to be put in place through the resource consenting process to manage the effects of new dairy farming on water quality.

The proposed changes have effect from the date of notification, pursuant to Section 86B of the Resource Management Act 1991, as the proposed changes are Section 9 (land use) provisions for which the purpose is to protect water quality.
