A Land Information Memorandum (LIM) is a report prepared by the Marlborough District Council at your request. It provides - specific to the property requested.
- Information identifying each (if any) special feature or characteristic of the land concerned including, but not limited to, potential erosion, avulsion, falling debris, subsidence, slippage, alluvion or inundation, or likely presence of hazardous contaminants, being a feature or characteristic that:
(i) is known to the territorial authority; but
(ii) is not apparent from the district scheme under the Town and Country Planning Act 1977 or a district plan under the Resource Management Act 1991.
- Information on private and public stormwater and sewerage drains as shown in the territorial authority's records.
- Information relating to any rates owing in relation to the land.
- Information concerning any consent, certificate, notice, order or requisition affecting the land or any building on the land previously issued by the territorial authority (whether under the Building Act 1991 or any other Act).
- Information concerning any certificate issued by a building certifier pursuant to the Building Act 1991.
- Information relating to the use to which that land may be put and conditions attached to that use.
- Information that, in terms of any other Act, has been notified to the territorial authority by any statutory organisation having the power to classify land or buildings for any purpose.
- Any information that has been notified to the territorial authority by any network utility operator pursuant to the Building Act 1991.
The memorandum may also include other information the council considers relevant.
If you are considering purchasing a property you may want to obtain a LIM before finalising the purchase. The report is processed within 10 working days. Working days are suspended for Marlborough Anniversary and the Christmas/New Year period when Council offices are closed (please contact Council for specific dates.). LIM application forms are available on-line (in the FORMS section) or you can pick one up from the Customer Service Centre or phone and ask for one to be sent to you. Please make sure you include all the information requested (including a copy of the Certificate of Title) so that the application can be processed as quickly as possible.
The fee for a LIM for a Residential or Rural Residential property (effective from 1 July 2009) is $315.
The fee for a LIM for Commercial, Industrial, Farm, Winery, Vineyard etc (i.e. properties with a business type use) (effective from 1 July 2009) is $545.

If you are about to buy a property and build on it, it is a good idea to obtain both a LIM (to check out the land) and a PIM (to make sure your building project will meet planning requirements etc).
