Issued under Clause 7.1.1 of the Navigation Safety Bylaw 2025 and Section 33M of the Maritime Transport Act 1994
Purpose
This exemption is granted to allow specified lodge tenders vessels to operate without AIS transmission requirements under Clause 5.4.3 of the Navigation Safety Bylaw 2025 (the “Bylaw”), while maintaining safe navigation practices.
Scope
The Navigation Safety Bylaw 2025 clause 5.4.3 requires: In addition to [Commercial Vessels 300 Gross Tonnage or more, or a tug and barge exceeding 40 metre in Length.
- All Commercial Vessels over 18 metres in Length;
- Any passenger vessel licenced to carry 12 or more passengers; or -
- Any passenger vessel operating during the Hours of Darkness or in restricted visibility Shall transmit an AIS signal when within Marlborough Harbour Limits
Tender vessels operated by or on behalf of the following lodges are exempt from the requirement in Clause 5.4.3 to carry and transmit an AIS signal when operating within Marlborough Harbour Limits.
Conditions
- The tender must operate exclusively for lodge-related purposes.
- The tender must operate in normal proximity to the lodge.
- The tender must remain within the bay of the lodge.
- The exemption does not apply if the vessel departs the bay or engages in unrelated commercial activities.
- All other purposes of the Bylaw remain applicable, including speed limits, lifejacket requirements, and communication standards.
Duration
This exemption is valid from 20 November 2025 to 31 December 2030, unless surrendered by the lodge or revoked by the Harbourmaster.
